The scope covered not only foreign governments, companies, and individuals outside the US, but also foreign nationals within the United States — including Anthropic’s own foreign employees. The so-called “deemed export” doctrine — treating a foreign national accessing the technology as a technology transfer — was applied to an AI model. However, Anthropic understood the government to be concerned about a potential “jailbreak” of Fable 5’s safety measures — a demonstration of getting the model to read code and identify vulnerabilities. The company publicly pushed back: “We disagree that a commercial model used by hundreds of millions of people should be recalled on the basis of one narrow potential jailbreak. Applied consistently, this standard would effectively halt all new frontier model releases.” Anthropic would comply — but not agree.

Why This Matters — The Control Line Moves from Chips to Models

The weight of this event does not lie in “one Anthropic model was blocked.” It lies in the fact that what is being controlled has changed. Until now, US AI export controls targeted the hardware used to train AI — Nvidia GPUs, semiconductor manufacturing equipment. The logic was: deny access to chips, and building frontier models becomes impossible. This time, the government stopped an already-built model — a software artifact — at the border directly.

This signals that frontier AI models have been reclassified from ordinary SaaS products to strategic infrastructure.
